Guidelines for use of FISKARS BRANDS, INC. Trademarks

FISKARS BRANDS, INC. "trademarks" include the various Fiskars logos including the black rectangle, the oval functional form, and all other designs owned and used by Fiskars (collectively referred to herein as "logos"), as well as Fiskars product names. Fiskars takes great care in the development and protection of its trademarks and reserves all rights of ownership of its trademarks.

FISKARS BRANDS, INC. limits the use of its logos. No other company may use FISKARS BRANDS, INC. logos unless it has the express written permission of FISKARS BRANDS, INC.

Fair use of FISKARS BRANDS, INC. product names
"Fair use" of trademarks allow third parties to make reference (text ONLY) to Fiskars product names. The following guidelines are published to ensure proper use and reference to Fiskars product names.

While fair use allows use of or reference to Fiskars product names, it is necessary that the usage be truthful, not disparaging to Fiskars, and does not mislead the public. You must be clear and accurate as to the nature of the relationship between FISKARS BRANDS, INC. and your company, its products or services.

Following are two common types of fair use:

Use of Fiskars product names by third parties is allowed by FISKARS BRANDS, INC. without permission or license when specifically referring to Fiskars products.

Example: The Fiskars ShapeBoss is an embossing system.
Use of Fiskars product names by third parties is allowed without permission or license when indicating that Fiskars product is compatible with another product.

Example: XYZ is compatible with Fiskars CardBoss.

General rules for proper reference to Fiskars product names

Following are two common types of fair use:

The first use of each Fiskars product name mentioned in communications must be identified in a footnote or attribution. The attribution must be located either on the page/screen where the Fiskars product name is used, or in the legal section of the communication or site in which it is referenced. Please note that laws concerning use of trademarks or product names vary by country. Always consult a local attorney for additional guidance.

Example: Fiskars ShapeBoss and UpRoot are trademarks of FISKARS BRANDS, INC. in the United States, other countries, or both.
In the United States, the first reference in txt to all Fiskars product names should be preceded by Fiskars and followed by the proper trademark symbol. The proper symbol for registered product names is ® The proper symbol for product names which are the subject of pending applications or are used in accordance with common law trademark principles is ™.

Example: The Fiskars® ShapeBoss® embossing system is great for scrapbooking. The Fiskars® Softgrip™ pruners are great for trimming...

Rules for marking product names differ by country. You may need to seek guidance from a trademark professional.
A product name should be used as an adjective qualifying a noun that is a generic description of the product or service. The product name should also be used in singular form.

Example: Ten Softgrip scissors were sold...
Do not change the form or representation of the product name, including capitalization or punctuation.

Example: ShapeBoss®, CardBoss®, Power Gear®

Incorrect Use of Fiskars trademarks

Do not omit a footnote/attribution for Fiskars trademarks.
Do not alter the approved Fiskars trademark.
Do not create any new logo for Fiskars or Fiskars product names.
Do not incorporate any Fiskars product names into your company's product names.
Do not incorporate any Fiskars product names into the root domain of any Web site owned by your company.
Do not misspell when using the name Fiskars in text.
Do not use the Fiskars taglines.
Do not connect your company name with Fiskars product names.
Do not use the Fiskars trademark name for a product or service as a noun, or in the plural form.
Do not misspell or incorrectly capitalize Fiskars trademarks. Always include Fiskars before the trademarked Fiskars name on the first usage.
